Cancellation of the contract by a court decision is basis the unconditional for inclusion in RUS

Irrespective of the reason for which the court has terminated the contract the information about the supplier, the contractor or the performer has to be included in the register of unfair suppliers (RUS). A conclusion of the Ministry of Economic Development is based on provisions of the Law N 44-FL.

Having analysed an explanation, it is possible to draw the following conclusion. Information on the supplier will be reflected in RUS and in that case when the court has terminated the contract because of essential change of circumstances, but not because of the allowed violations. At the same time some courts recognize illegal inclusion of data in RUS if as a result of such change of circumstances the contract hasn't been executed.
