The supplier with whom it is terminated the contract, can't fulfill guarantee certificates

The conclusion concerns suppliers who significantly violated terms of the contract.

We believe that at such approach suppliers, contractors can be exempted from a duty to eliminate defects which are revealed in the put goods, results of the performed works during a warranty period.

This conclusion of the Ministry of Economic Development doesn't coincide with a position YOU the Russian Federation according to which the term of the contract, to apply which is supposed and after its cancellation, remain in force. Guarantee certificates belong to such conditions, for example.

As disputes between the parties of the contract are considered in a judicial proceeding, it is more expedient to customers to adhere to a position of court.
