The third party has no right to bring tender security for the participant

In this regard the court considered that the customer legally recognized the demand contradicting requirements of the Law N 44-FL. According to this Law only the participant of purchase and bank which conforms to requirements of the Law (when providing the bank guarantee) can bring tender security on participation in competition.
The antimonopoly service specified that the third party brought tender security legally as in the Law N 44-FL there is no ban to other persons to provide providing. The argument wasn't accepted by court.
