Isn't provided to change and supplement the bank guarantee with the law N 44-FL

New providing is provided if it is necessary to reduce the amount of ensuring performance of the contract for the sum proportional to volume of the fulfilled obligations. According to the Ministry of Economic Development, is inadmissible to make changes to the bank guarantee which is earlier provided as providing the contract.

However the Law N 44-FL doesn't contain a direct ban to make such changes. The bank which gave out a guarantee, in particular, has to include information and documents on it in the register no later than one working day following behind day of modification.

Earlier department specified that it is necessary to refer to similar changes only correction of conditions of a guarantee or its requisites filled in an inadequate way. Data on it have to be reflected in the register of bank guarantees.
