FAS issued a procurement standard of the Law N 223-F

This standard is a recommendation to customers engaged in procurement activities on the basis of Law N 223-FL. It is aimed at reducing the risk of offending in the procurement.

Some of the recommendations differ from the current judicial practice. For example, in the state proposed to ban the purchase of set requirements for goods supplied, which corresponds to a single commodity producer. The exception is when you need to ensure technological compatibility and purchase unique products. At the same time the courts allow the possibility to provide for such requirements, if they are due to the customer's needs (see. Resolution of the Federal District of the Far East 17.01.2014 N F03-6483 / 2013 in the case N A51-11707 / 2013).

We emphasize that many of the proposed recommendations are similar to the provisions of Law N 44-FL. Thus, there is a convergence of procurement rules certain kinds of legal entities with the rules that govern the conduct of procurement for state and municipal needs.
