Explained the features of the contract for connection to the mains

According to the position of the FAS Russia Purchaser can make a single supplier contract for the provision of connection to electric networks based on n. 1 p. 1, Art. 93 of the Federal Law of 05.04.2013 N 44-FL (contract with the single supplier for the purchase of services related to the field of natural monopolies).

This position of the competition authority is reflected in a letter dated 03.02.2015 N AC / 4119/15, it is based on the definition of the Russian Federation of 10.07.2009 N 6057/09 in the case N A49-3724 / 2008-120a / AK-21. In this definition, the court noted that the services of technological connection to electric networks do not constitute a separate product market and are part of the market of electric power transmission. Services for electric power transmission belong to the sphere of natural monopolies (p. 1, Art. 4 of the Federal Law of 17.08.1995 N 147-FL).
