Check compliance can be of participant request for quotation uniform requirements in any way

According to the position of The Ministry of Economic Development of Russia quoted the commission did not have the right to bind the confirm their compliance with uniform requirements set out in the documentation on the basis of p. 1, Art. 31 of the Federal Law of 05.04.2013 N 44-FL. If the application is not part the confirmation, quoted commission has the right to verify compliance with the requirements called by any means (for example, by using public databases authorities, registers).

This position is reflected in the Letter of Ministry of Economic Development of Russia from 31.12.2014 N D28i-2918.

The customer has the right to dismiss a participant from participating in the procurement at any time prior to the conclusion of the contract, if it is found discrepancy including uniform requirements or established that was presented false information in relation to the specified requirements of relevant actors (p. 9, art. 31 of the Federal Law of 05.04 .2013 N 44-FL).

In addition, the customer is obliged to unilaterally withdraw from the execution of the contract, in the case when in the course of its implementation showed that the counterparty does not comply with a notice of the request for quotations requirements or submitted false information on their compliance to them (p. 15, art. 95 Federal Law of 05.04.2013 N 44-FL).
