How to indicated in the contract draft provision about fines?

The size of the fine in the contract shall be determined in accordance with the rules approved by Russian Federation Government Decree of 25.11.2013 N 1063 (the Rules). So, for the improper performance of the supplier obligations in Sec. 4 of the Rules provides various sizes of the fine depending on the price of the contract.
Applying this provision, customers are faced with a problem: at the time of the contract drafting the price of the contract is not yet known, which invited participants. Thus, in this project including the specific amount of the fine, the customer will not be entitled to change based on the price offered by the participant.
