Price contract with a single supplier will need to always justify
On January 1, 2015, customers will justify contract initial maximum price (contract price) in accordance with Art. 22 of the Federal Law 05.04.2013 N 44-FL of the formation of the schedule for 2016 and subsequent years, including all purchases with a single supplier. This conclusion is also reflected in the Letter from the Russian Ministry of Economic Development 07.10.2014 N OG-D28-7698.
In justifying contract initial maximum price (contract price), customers can be guided by the methodological recommendations approved by the Order of the Ministry of Economic Development of Russia from 02.10.2013 N 567.
Currently under contract with a single supplier requires justification of the contract price in all cases other than those listed in Part. 3 it. 93 of the Federal Law 05.04.2013 N 44-FL. It is reflected not in the schedule, and in the draft contract and report. We emphasize that after the introduction of the obligation to justify the price of the contract schedule in these cases, the duty to provide such a justification in the contract and the report will remain.
In respect of purchases listed in p. 3 it. 93 of the Law, the rationale for the price of the contract must be given only in the schedule. For example such cases include the conclusion of a contract with a single supplier for an amount not to exceed 100 thousand rubles
