The Ministry of Economic Development and Trade of Russia noted limitations on ensuring performance of contract

In a letter dated 19.09.2014 N D28i-1893 Department indicated that the Federal Law of 05.04.2013 N 44-FL has not presentation:
- Several bank guarantees to secure a contract;
- Providing a third person who are not in members of the procurement;
- Mixed providing a contract in the form of a bank guarantee and depositing funds to the account of the customer.
Recall that if the proper ensuring performance of contract is not provided within the prescribed time, the member has evaded the contract. Therefore, it shall be included in the register of unfair suppliers (ch. 2, Art. 104 of the Federal Law of 05.04.2013 N 44-FL).
