Public procurement admit only offshore from the "white list"

The Government of Russia has prepared a draft law to limit participation offshore in government procurement, said in letter of First Deputy Prime Minister Igor Shuvalov to President Vladimir Putin from July 14, with text that read "Interfax".

 " Admittance of (registered in offshore jurisdictions - IF) companies to participate in state and municipal procurement is offered realize only if they disclose information about their beneficiaries, as well as the person performing the functions of the sole executive body, members of the collegial executing agency," - noted document.

 Disclosure of such information would not be mandatory for the procurement of clients, carrying out their activities outside of Russia, at the conclusion of a contract with a foreign organization for medical treatment abroad, as well as in some cases of purchases from a single supplier.

 Company located in an offshore jurisdiction, will be included in the registry. If the performance of the contract it appears that the offshore provider is excluded from the registry, including because of misreporting, the customer will be required to break the contract with him.

 Restrictions will affect not only the state orders, but also subcontracts for large contracts. If the contract price exceeds the government size, it will be included in the condition of the right to sub-contract supplier only with offshore companies from the register.  So plan to restrict the conclusion of state and municipal contracts with companies from offshore jurisdictions.

 In the case of the president's consent bill will be prepared by the Government to be submitted for consideration by the Duma, says Shuvalov.

 Ministry of Economic Development has begun to develop a document on limiting offshore participation in public procurement in the end of January. A notification has been published on a single portal to accommodate draft regulations. Then the wording was tougher: to justify the preparation of the draft referred to "ban the conclusion of the state or municipal contracts with companies located in an offshore jurisdiction."

 De-offshore of Russian economy has been one of the main themes of Putin's last message to the Federal Assembly and entered into signed in late December, a list of instructions for its implementation. Then the Russian president announced a series of proposals aimed at achieving this goal. Government had prepared a draft law on the taxation of companies in offshore, on a ban on the provision of state support to companies as well as to prepare amendments to the legislation which introduced a ban on the conclusion of the state or municipal contracts with these companies.

 According to the orders of the president prepared to implement the message, these initiatives should have been done by the government up to July 15, 2014. As reported in the Ministry of Economic Development, the draft law would not participate in the offshore in government purchase agency was going to develop by May.
