Starting from July 1, 2026, it is planned to introduce mandatory standard contract terms in procurement under Law No. 44-FZ, which unify the measures of responsibility of the parties. The relevant draft resolution has been prepared by the Government of the Russian Federation based on the proposals of the Accounts Chamber.
Terms of the claim work
The customer is obliged to send a claim within three working days after the violation is detected. The response to the claim is also given within three days. The supplier must fulfill the requirements (pay fines, penalties, refund the advance) no later than seven working days. Similar rules apply to the supplier when submitting claims to the customer.
Collection procedure
A priority scheme is being established: first, deduction from payment under the contract, and if it is not possible, recourse to an independent guarantee. A claim for a guarantee must be submitted before the end of its validity period.
Control over the advances
If the advance paid exceeds the obligations actually fulfilled, the customer reduces the next payment or sends a request for a refund of the difference (within three business days).
The balance of the parties
The supplier gets the right to make claims to the customer, demand penalties for late payment and collect fines for improper execution.
The decree comes into force on July 1, 2026 and applies to purchases placed after that date.
