The Ministry of Finance explained the specifics of the NMCC justification when using industry procedures

The Agency noted that if the customer uses special industry procedures approved by federal authorities to calculate the initial (maximum) contract price, he does not need to additionally justify the impossibility of using the methods listed in Part 1 of Article 22 of Law No. 44-FZ.

Such justification is required only if the customer cannot apply any of the standard methods at all (for example, the method of comparable market prices, tariff method, etc.). The industry procedures established under Part 22 of Article 22 of Law No. 44-FZ (for medical products, medicines, fuel, security services, and others goods, works, and services), do not apply to these methods.

Thus, if an industry-specific procedure for determining the NMCC is provided for a specific purchase, its use does not require a separate justification for the impossibility of using other methods.
