FAS explained: when are foreign spare parts allowed according to technical documentation

The Federal Antimonopoly Service clarified the procedure for the application of Resolution No. 1875, which regulates the national procurement regime.

The essence of the explanations:

Customers have the right not to apply restrictions when purchasing spare parts and consumables for machines and equipment, if such goods are explicitly provided for in the manufacturer's technical documentation.

Technical documentation refers to operating manuals, instructions, product data sheets, and other documents that define the rules for the use, maintenance, and repair of equipment.

The FAS emphasized that the issue of the legality of the purchase is always considered individually at control events. Therefore, it is important to preserve and apply the technical documentation as part of the justification.

For customers, this means that foreign spare parts can be purchased reasonably and without risk of infringement, but only if there is a documentary confirmation from the manufacturer.
