Deadlines under control: important changes have been made to 44-FZ on construction supervision

From January 1, 2026, customers and contractors will be able to flexibly adjust the deadlines for the execution of construction control contracts. This is provided for by Federal Law No. 333-FZ dated 07/31/2025, which amended Article 95 of Law No. 44-FZ "On the Contract System".

Now the deadlines for the execution of construction control contracts can be changed in proportion to the postponement of the main contract — for construction, reconstruction or overhaul. However, all other essential conditions remain unchanged.

Previously, the situation when control work was completed before the completion of the main work created risks for participants in the contract system. Any discrepancies in the deadlines could lead to fines, disputes, and even termination of contracts.

The new rule is aimed at eliminating this legal uncertainty and increasing the synchronicity of the fulfillment of obligations. As a result, participants will be able to make changes quickly and avoid responsibility for delays caused by the objective linking of control to the main work.

The changes are particularly relevant for projects with a long implementation cycle, including in the construction of social, transport and engineering infrastructure. Law No. 333-FZ comes into force on January 1, 2026, and customers should already take this opportunity into account when planning long-term contracts.
