The Ministry of Finance of the Russian Federation explained the specifics of the application of protective measures when purchasing first aid kits. The response to the request draws attention to:
- subparagraph "d" of paragraph 4 of Resolution No. 1875 establishes that the items of Appendix No. 2 to Resolution No. 1875 apply if the object of purchase includes a product whose name is indicated in the column "Product name" and which is included in the code indicated in the column "Product code according to the All-Russian Classifier of products by types of economic activity OK 034-2014 (CPA 2008)";
- if a medical device is included in the object of purchase, the corresponding position is applied if the purchased medical device also refers to the type code of the medical device indicated in the column "Product name" in accordance with the NCMI approved by the Ministry of Health of the Russian Federation.;
- Appendix No. 2 to Resolution No. 1875 is a list of goods (their names) for which a restriction is established, and not a list of codes according to OKPD 2, when used in the purchase of which a restriction is applied.
In this regard, how should protective measures be applied to medical packages containing medical products?
- Item 376 of Appendix No. 2 to Resolution No. 1875, subject to the provisions of subclause "d" of paragraph 4 of Resolution No. 1875, applies exclusively to purchases of wound dressings and coverings soaked or coated with medicinal products, antiseptic alcohol napkins, gauze medical sterile and non-sterile;
- Item 376 of Appendix No. 2 to Resolution No. 1875 does not apply to purchases of first aid packages using medical devices by police officers.
- At the same time, the protective measure provided for by Resolution No. 1875 in the form of an advantage is applied to goods not listed in Annexes No. 1 and No. 2 to Resolution No. 1875.
