From January 1, 2026, customers concluding contracts under paragraph 9 of part 1 of Article 93 of Law No. 44-FZ (emergency purchases from a single supplier) will have to indicate in the register of contracts the specific basis for concluding the contract. This procedure is provided for in the draft decree of the Government of the Russian Federation prepared by the Ministry of Finance of Russia.
Now, instead of a general formulation, the customer will need to choose one of six bases:
- provision of medical care in an emergency or emergency form
- accident
- emergency warning (when a high-alert mode is introduced)
- emergency response
- Provision of humanitarian assistance
- other circumstances of force majeure
This measure is aimed at increasing the transparency of purchases made on an emergency basis, and is being implemented based on the recommendations of the Accounts Chamber.
In addition, the project provides for other changes.:
Clarification of the procedure for maintaining the register of contracts — eliminates the need for additional verification of payment details if they have been changed as a result of organizational measures of the Bank of Russia and the Treasury.
The possibility of conducting purchases from the schedule throughout its entire validity period - the changes relate to the procedure for publishing notices, sending invitations and concluding contracts with sole suppliers.
The public discussion of the project will end on July 24, 2025.
