The law on amendments to Articles 31 and 43 of Law No. 44-FZ has been published

Amendments to Law No. 44-FZ will come into force on January 1, 2026, which will tighten the requirements for the reliability of information in procurement bids.

On June 7, 2025, Federal Law No. 138-FZ dated 06/07/2025 was published, clarifying the procedure for the procurement commission and the customer in cases where the procurement participant does not meet the requirements established in accordance with Article 31 of Law No. 44-FZ and provided false information on compliance with such requirements.

In the above cases, the obligation is provided for:

- suspension of the procurement participant from participation in the determination of the supplier at any time before the results are summed up

- the customer's refusal to conclude a contract with the procurement participant after summing up the results and before the conclusion of the contract

The law stipulates that the customer is obliged to refuse to conclude a contract if false information and/or documents are provided in the application for participation in the purchase.

In addition, the law assigns responsibility to the procurement participant for the unreliability of information and (or) documents in the application for participation in the procurement, as well as for actions performed on the basis of such information.

The law comes into force on 01.01.2026.
