National mode for the purchase of medical products: what should the customer consider?

In response to a request, the Russian Ministry of Finance indicated that when purchasing medical products, the restriction provided for in Resolution No. 1875 applies in the cases specified in sub-paragraphs "d" and "p" of paragraph 4 of Resolution No. 1875.

Thus, the positions of appendices No. 1 and No. 2 to Resolution No. 1875 are applied if the object of purchase includes:

• goods, work, and services, the names of which are indicated in the column "Name of goods, work, and services" and which are included in the code indicated in the column "Code of goods, work, and services according to the All-Russian Classifier of products by types of economic Activity OK 034-2014 (CPES 2008)";

• a product whose name is indicated in the column "Product name" and which is included in the code indicated in the column "Product code according to the All-Russian Classifier of products by types of economic activity OK 034-2014 (KPES 2008)" (subclause "d" of paragraph 4 of Resolution No. 1875).

If a medical device is included in the object of purchase, the corresponding position is applied when the purchased medical device also refers to the type code of the medical device indicated in the column "Name of the product, work, service" or column "Name of the product" in accordance with the nomenclature classification of medical devices, approved by the Government of the Russian Federation. The Ministry of Health of Russia.

By virtue of subclauses "p" of clause 4 of Resolution No. 1875, the restriction on purchases of goods specified in items 362-432 of Appendix No. 2 of Resolution No. 1875 is applied when purchasing goods that are medical devices.
