Calculation of NMCC for medical products
The Russian Ministry of Health clarified that contracts concluded with a single supplier in electronic form under part 12 of Article 93 of Federal Law No. 44-FZ can be used to calculate the initial price of medical products.
This conclusion is contained in the response to the request. The Department of Regulation of the Circulation of Medicines and Medical Devices noted that paragraph 10 of Order No. 450n does not contain restrictions that prevent the accounting of such contracts if they:
- concluded on the grounds provided for in paragraphs 4-5.2 of Part 1 of Article 93,
- executed properly,
- they were not accompanied by penalties.
The Ministry of Health clarified that Part 12 regulates the method of procurement (in electronic form), but the grounds for procurement themselves remain within the framework of Part 1 of Article 93, as required by the Procedure.
