It is proposed to introduce new types of violations in the Administrative Code for errors in treasury support
The new draft law being developed is aimed at measures to control the targeted use of budgetary funds in the execution of state (municipal) contracts (contracts, agreements).
It is proposed to add the following articles:
- Article 15.37.1 "Failure to comply with the requirements to keep separate records of the results of financial and economic activities in the execution of a state (municipal) contract (agreement, agreement), contract (agreement), the funds of which are subject to treasury support." Violation of these requirements limits the imposition of an administrative fine in the following amounts:
At the request of individuals: from 10,000 to 50,000 rubles or disqualification for up to three years.
For individual entrepreneurs: from 5 to 10 percent of the contract amount, but not more than 500,000 rubles.
For legal entities: from 5 to 10 percent of the contract amount, but not more than 1,000,000 rubles.
- In article 15.49, "Violation of the established deadline for approval of information on transactions with funds subject to treasury supervision by a state (municipal) customer, recipient of budgetary funds, by the customer." The following administrative sanctions are provided for this violation::
According to the statement of the persons: a fine in the company from 10,000 to 50,000 rubles.
According to the organization: a fine in the community of 1 to 5 percent of the amount of the state contract, but not more than 200,000 rubles.
It is proposed to entrust the consideration of cases of such violations to the Federal Treasury, as well as to the financial authorities of the regions and municipalities, in accordance with their competence.
