Explanations of the Ministry of Health of the Russian Federation on Resolution No. 1875: what is important for the buyer to know

The Russian Ministry of Health provided explanations on the application of the Decree of the Government of the Russian Federation dated December 23, 2024 No. 1875, regulating the national regime in public procurement.

1. Benefits apply only to products

The national regime applies exclusively to goods of Russian origin, regardless of whether they are provided separately or as part of the provision of services. If we are talking only about jobs or services without the delivery of goods, the benefits do not apply.

2. Conditions for the use of benefits

According to subparagraph "b" of paragraph 4 of Resolution No. 1875, an advantage is granted if:

- there is at least one product in the purchase that is not included in lists No. 1 and No. 2.;

- the purchase includes items from lists No. 1/2 along with items not included in these lists.

The presence of products from lists No. 1 and No. 2 does not prevent you from applying the advantage if other products are also present.

3. Exceptions: pricing features

The Ministry of Health notes that the specifics of the definition of NMCC, established by Resolution No. 1875, do not apply:

- medicines purchased by Order of the Ministry of Health of the Russian Federation dated December 19, 2019 No. 1064n;

- medical devices regulated by the Order of the Ministry of Health of Russia dated 05/15/2020 No. 450n.

For such categories, industry-specific methods should be followed, rather than the provisions of Resolution No. 1875.4.

Special features for strategically important medicines

If a medicinal product is included in the list of strategically important ones, but is produced outside the EAEU countries, its application will be recognized as foreign and rejected.
