February updates for purchasing specialists

In February 2025, many significant events took place for procurement specialists. A new procedure for notification of the need for centralized public procurement for federal needs has been introduced, and the rules for verifying documents that customers submit under Law No. 223-FZ to include information about a participant or counterparty in the RNP have been approved. These and other key changes are in the review.

Changes in legislation:

Since February 28, 2025, a new procedure has been introduced for sending information on the needs of federal executive authorities in centralized public procurement of goods, works and services.

Since February 11, 2025, the rules for verifying documents for including information about participants in the RNP under Law No. 223-FZ have been in effect.

Since February 4, 2025, the regional authorities have begun to check the procurement plans of a larger number of customers in terms of procurement for MSPs.

Judicial practice:

The Supreme Court of the Russian Federation upheld the state customer who withheld the penalty for late execution of the contract stage, despite its small size (less than 5% of the contract price).

The court also disagreed with the supervisors who included information about the contractor in the RNP two years after the occurrence of such a duty, pointing to a violation of Law No. 44-FZ.

In addition, the Supreme Court of the Russian Federation canceled the explanations of the Federal Antimonopoly Service on the conditions for granting benefits to organizations with disabilities, indicating that regional units are also entitled to these benefits.

Explanations of the departments:

The Ministry of Finance clarified who is subject to prohibitions, restrictions and advantages in public procurement, and also explained the specifics of the description of procurement facilities and the justification of the NMCC.

The Ministry of Finance also answered the question about the application of the innovation regarding the conclusion of individual government contracts with a single supplier in a simple written form.

The Ministry of Industry and Trade noted that an entry from the RAP registry is not suitable for confirming the country of the product when applying the national regime.

The FAS explained that an extract from the register of licenses for security activities, indicating the Russian Federation without a specific address, confirms special legal capacity in public procurement.

The Ministry of Natural Resources explained that the lists of goods with a minimum share of recyclables were approved only for state support measures, and not for public procurement.

Projects and plans:

A reduction in the price threshold for public procurement is being discussed, at which complaints will be considered by the central office of the Federal Antimonopoly Service.

It is proposed to change the rules for rationing car purchases: to switch to the priority of electric vehicles and gas-powered vehicles, allowing gasoline and diesel models only in exceptional cases.
