The President of Russia signed Federal Law No. 500-FZ dated December 28, 2024, amending the Code of Administrative Offenses (CAO) in the field of procurement. The document updates the composition of administrative offenses and introduces new liability measures for violations of the legislation governing procurement under 223-FZ.
- According to Law No. 44–FZ, not only customers, but also banks, as well as operators of specialized electronic trading platforms can be brought to administrative responsibility for violations.
- One of the key innovations was the introduction of liability for customers who do not comply with the requirements for a mandatory share of purchases from small and medium-sized enterprises (SMEs). Previously, such a measure applied only to customers working under 44-FZ.
- Additionally, liability is introduced for non-compliance by the customer with the deadlines or the procedure for concluding contracts based on the results of purchases, the participants of which are exclusively SME entities.
- In addition, operators of electronic and specialized electronic platforms will now be responsible for violations of the procurement legislation under 223-FZ. Previously, the FAS limited itself to issuing prescriptions in such cases.
