Amendments have been made to regulatory legal acts regulating procurement
On December 10, 2024, Decree of the Government of the Russian Federation No. 1740 of December 09, 2024 was published, which amends some acts of the Government of the Russian Federation on procurement issues.
KEY INNOVATIONS FROM 01.01.2025
In terms of providing access to open data in machine-readable form: obtaining such information will be possible only through information retrieval services after identification, authentication and authorization in the GIS of the EIS of PROCUREMENT using a unified identification and authentication system.
KEY INNOVATIONS SINCE 07/01/2025
Regarding the formation of a digital contract and the inclusion of information in the register of contracts:
- for contracts for the provision of public services, it is provided to specify the account details of an agent acting on behalf of a single supplier, including a payment agent or a bank payment agent (if such an agent is involved)
- when purchasing residential premises, it is provided to specify the account details of the representative and the owner of such residential premises
The specified details can be used for further payment by the customer.
Regarding the register of contracts:
- it is provided for the inclusion of information and documents on the termination of the contract (obligations under the contract) in the case of:
- the expiration of the contract, if the contract contains a condition that the expiration of the contract entails the termination of the obligations of the parties
- liquidation of a legal entity that is a customer or supplier. At the same time, such information is placed automatically based on the data of the Unified State Register of Legal Entities
- the death of a citizen who is a supplier
- it is established that in case of loss of information on the performance, termination, termination of the contract (obligations under the contract), information on the termination of the contract is formed by the Federal Treasury on the basis of an appeal.
Such an appeal may be submitted only by one of the following bodies and must contain information on the establishment of the fact of performance, termination, termination of the contract (obligations under the contract):
- the federal executive authority, the executive body of the subject of the Russian Federation, exercising control in the field of procurement
- The Accounting Chamber or the control and accounting body of the subject of the Russian Federation
- The Prosecutor General's Office or the Prosecutor's Office of the subject of the Russian Federation
