In Law No. 223-FZ, a norm may appear that allows evaluating applications according to a price criterion, taking into account the participant's tax regime
A draft federal law has been submitted to the State Duma for consideration, which provides for granting customers guided by Law No. 223-FZ the right to establish the procedure for evaluating applications according to a price criterion, excluding VAT amounts. In particular, it is assumed that in this case, the reduction of the participants' price offers to a single basis will be carried out by deducting the amount of tax from the prices offered by the participants who are VAT payers. In this case, the contract will be concluded at the price offered by the participant in the application.
The authors of the project note that the introduction of these amendments to Law No. 223-FZ will allow customers using the general taxation system to exercise the right to receive a tax deduction.
