Law No. 223-FZ has been supplemented with provisions on the provision of national treatment for procurement

On October 1, 2024, new Articles 3.1-4, paragraph 5 of Part 8 of Article 3, paragraph 8.3 of Part 9 of Article 4 of Law No. 223-FZ, as well as amendments made to paragraph 12 of Part 19.1 of Article 3.4 of Law No. 223-FZ, enter into force. At the same time, these norms apply to purchases, notices of the implementation of which are posted in the Unified Information System and invitations to participate in which are sent or contracts with sole counterparties in the implementation of which have been concluded since January 1, 2025.

The model procurement regulations must be brought into line with the new requirements of Law No. 223-FZ, approved and posted in the Unified Information System by December 1, 2024. Recall that by virtue of the new Article 3.1-4 of Law No. 223-FZ, a national procurement regime is provided that provides foreign goods, works, and services with equal conditions with Russian ones, except in cases when the Government of the Russian Federation takes measures establishing prohibitions and restrictions on purchases of foreign goods, works, and services, as well as advantages in relation to Russian goods, works, services. Unless otherwise provided for by these measures, the provisions of art. 3.1-4 of Law No. 223-FZ concerning Russian goods, works, and services are also applied to foreign goods, works, and services that are provided with equal conditions with Russian ones. If the above measures are taken, the Government of the Russian Federation also determines information and a list of documents that confirm the country of origin of the goods. Information on the prohibition or restriction of purchases of foreign goods, works, services, and advantages in relation to Russian goods, works, and services is indicated by the customer in the notification.
