The Ministry of Construction pointed out the main violations and their possible consequences when sending project documentation for examination
The letter of the Ministry of Construction of the Russian Federation No. 37463-AL/08 has been published on the legal information portal. It is addressed to government customers, as well as organizations engaged in architectural and construction design and conducting state expertise of project documentation and engineering survey results.
The letter prepared by specialists of the Ministry of Construction of the Russian Federation, in particular, informs about the facts of sending by customers for state expertise of project documentation developed by organizations determined on the basis of competitive procedures, without specifying in the sent documents information about the specialists who prepared and approved the specified documentation. According to representatives of the Ministry, this indicates violations of the law. In addition, in some cases, the project documentation was approved by an employee of the subcontractor organization, and not by the general designer. And the delay in the timing of the state examination is often associated with poor-quality work of the customer, failure to submit or incomplete submission of initial permits.
At the same time, representatives of the Ministry of Construction of the Russian Federation note that in case of claims to the project documentation, these violations will lead to the impossibility of compensation for losses and compensation for damage caused to the customer or the organization that will subsequently operate the constructed facility.
