On July 1, the provisions of Federal Law No. 44 come into force, establishing a new basis for purchasing from a single counterparty
From this date, a new paragraph 6.1 of part 1 of Article 93 of Federal Law No. 44 is in effect, providing for the possibility of purchasing by executive authorities of a subject of the Russian Federation, state institutions of a subject of the Russian Federation, municipal institutions of municipalities that are part of a subject of the Russian Federation from a single counterparty:
- medicines;
- specialized medical nutrition products;
- medical devices;
- supplies;
- disinfection products;
- services for the storage and delivery of the specified goods;
- repair and maintenance of medical devices.
Contractors for these purchases may be state unitary enterprises of the relevant subject of the Russian Federation or joint-stock companies, 100% of whose shares belong to the subject of the Russian Federation.
Customers are required to notify the control authority of the purchase. You will also need to justify the price of the contract and include this justification in the contract.
In addition, from this date, the application of the provisions of part 76 of Article 112 of Federal Law No. 44 and part 16 of Article 8 of Federal Law No. 223, which establish the temporary features of procurement of products by medical institutions, ceases.
