Amendments have been made to the Law of the Republic of Tatarstan No. 44-FL

In accordance with Federal Law No. 124-FL dated 05/29/2024, signed by the President of the Russian Federation, some provisions of Law No. 44-FL are being adjusted. In particular, the new version contains the definition of the concept of "customer" provided for in paragraph 7 of part 1 of Article 3 of Law No. 44-FL, which is now explained, among other things, by the legal entities specified in Part 4, Part 4.3 and Part 4.4 of Article 15 of Law No. 44-FL. At the same time, Article 15 of Law No. 44-FL has been supplemented with a new part 4.4, obliging joint-stock companies, 100% of which belong to a subject of the Russian Federation, when making purchases in order to fulfill obligations under contracts concluded in accordance with paragraph 6.1 of part 1 of Article 93 of Law No. 44-FL. Part 4 of Article 15 of Law No. 44-FL is also spelled out in a new version, providing for the need to comply with the provisions of Law No. 44-FL not only by autonomous institutions, but also by other legal entities. And Part 4.1 and Part 5 of Article 15 of Law No. 44-FL have been declared invalid.

In addition, the list of procurement cases carried out by closed methods provided for in paragraph 5 of part 11 of Article 24 of Law No. 44-FL has been supplemented. In particular, the methods of closed competition are also used in the case of procurement:

- at the expense of funds provided from the federal budget within the framework of agreements on the provision of subsidies or budget investments with the condition of using closed competition methods;

at the expense of budgetary funds provided within the framework of agreements between law enforcement agencies on the provision of subsidies or budget investments concluded with customers or customers, international sanctions apply against them;

carried out by budgetary institutions, autonomous institutions, unitary enterprises or other legal entities on behalf of the above-mentioned customers.

These changes will take effect on January 1, 2025. In addition, legal entities that have received subsidies provided for in subparagraph 2.1 of paragraph 1 of Article 78.3 of the Criminal Code of the Russian Federation carry out purchases at the expense of these subsidies in 2024 in accordance with part 4.1 of Article 15 of Law No. 44-FL. This provision has been in effect since June 9, 2024.
