They plan to adjust the rules of 44-FL again

The Ministry of Finance has prepared draft amendments to Law No. 44-FL. The Agency proposes to supplement article 15 with new rules on procurement by budgetary, autonomous institutions and unitary enterprises.

The amendments relate to the procurement of goods, works, and services that are necessary for the creation and operation of state information systems. Such systems may be part of government digital platforms or ecosystems.

Budgetary and autonomous institutions, state unitary enterprises and municipal unitary enterprises, as well as other organizations listed in article 15 of the Law, will purchase goods, works and services for the operation of state information systems according to the rules of Law No. 44-FL, if the contract is paid for by subsidies and grants. But there are exceptions. These are special cases from normative acts, on the basis of which state information systems are created, introduced or decommissioned.

In the same document, amendments to Law No. 149-FL "On Information, Information Technologies and Information Protection" were listed. The conceptual framework and the legal basis for the work of state information systems have been clarified.

The project is currently undergoing a regulatory impact assessment stage. If the amendments are adopted, the new version of Law No. 44-FL will enter into force 90 days after the official publication of the draft.
