The special procedure for procurement in the territories of new subjects of the Russian Federation has been extended

For 2024, the procurement features are extended to meet the state needs of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporozhye region, the Kherson region and the needs of municipalities located on their territories, established by paragraph 2 of the decree of the Government of the Russian Federation dated December 31, 2022. No. 2559 "On measures to ensure the martial law regime and on the specifics of planning and implementing purchases to meet the state needs of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporozhye region, the Kherson region and the municipal needs of municipalities located on their territories, and on amendments to certain acts of the Government of the Russian Federation" (hereinafter - the Resolution N 2559).

In addition, state and municipal institutions, as well as state and municipal unitary enterprises operating in territories where martial law has been imposed, are equated to customers who, by virtue of subparagraph "a" of paragraph 1 of Resolution No. 2559, have the right to purchase from a single counterparty.

Resolution of the Government of the Russian Federation dated 11/30/2023 No. 2039 will enter into force on December 9 of this year.

Recall that by virtue of subparagraph "b" of paragraph 2 of Resolution No. 2559, customers, when making purchases to meet the state needs of the Donetsk People's Republic, the Luhansk People's Republic, the Zaporozhye region, the Kherson region and the municipal needs of municipalities located on their territories, have the right not to be guided by the provisions of Articles 19, 20, 30, parts 2-4 of the article 31, part 6 of Article 38 and part 5 of Article 39 of Federal Law No. 44. In addition, these customers have the right to make purchases from a single counterparty according to the rules established for purchases in territories where martial law has been imposed.
