The procedure for issuing a permit by the Ministry of Industry and Trade for the purchase of foreign goods under Federal Law No. 44 has been clarified
Specialists of the Ministry of Industry and Trade of Russia in their letter noted that the indication in the application for the issuance of a permit for the purchase of an industrial product originating from a foreign state of the cost characteristics of the purchased product provides additional information to identify Russian manufacturers of analogues of this product. This information is indicated in the application in accordance with paragraph 5 of the Procedure approved by the order of the Ministry of Industry and Trade of Russia dated 29.05.2020 N 1755.
It is also emphasized that when posting information about the procurement procedure, the characteristics of an industrial product identical to the characteristics submitted by the customer to the Ministry of Industry and Trade of Russia for obtaining a permit provided for in subparagraph "a" of paragraph 3 of the Decree of the Government of the Russian Federation of 30.04.2020 N 616 (hereinafter referred to as Resolution N 616) are indicated. In this regard, the establishment by the customer of additional product characteristics not contained in the permit is not allowed. A copy of the application on the basis of which the permit was issued is an integral part of the issued permit. At the same time, the customer places information on the results of the purchase of goods using a permit in the personal account of the state information system of industry within 10 working days after the conclusion of the contract.
Recall that Resolution No. 616 establishes a ban on purchases of industrial goods provided for in the list attached to this resolution (hereinafter referred to as the List) originating from foreign countries. At the same time, paragraph 3 of Resolution No. 616 lists cases-exceptions in which the ban on the purchase of goods included in the List does not apply. In particular, these cases include the absence of production of industrial goods on the territory of Russia, which is confirmed by the presence of a permit for the purchase of industrial goods originating from a foreign state, issued in accordance with the procedure established by the Ministry of Industry and Trade of Russia (subparagraph "a" of paragraph 3 of Resolution No. 616).
