The Supreme Court of the Russian Federation confirmed the right of the Federal Antimonopoly Service of Russia to cancel decisions of regional departments to include suppliers in the register of unscrupulous suppliers
The regional administration commission of the Federal Antimonopoly Service of Russia satisfied the customer's request to include information about the counterparty in the register of unscrupulous suppliers due to the latter's failure to fulfill obligations under the contract. The decision of the antimonopoly authority was appealed to the Federal Antimonopoly Service of Russia, which instructed the lower body to cancel the corresponding decision.
Considering his rights to be violated, the customer applied to the arbitration court with a statement to recognize the decision of the central office of the Federal Antimonopoly Service of Russia as illegal. By decisions of courts of three instances, the stated demands were rejected. At the same time, the courts noted that the appealed decision of the Federal Antimonopoly Service of Russia complies with the provisions of paragraph 2 of Part 15 of Art. 99 of Federal Law No. 44 and issued by the antimonopoly authority within the limits of the powers granted.
The Supreme Court of the Russian Federation also found no grounds for reviewing the case.
