The Ministry of Finance explained the specifics of conducting electronic small purchases under Law No. 44-FZ
The agency reported: an electronic small purchase from a single supplier is carried out if there is a position in the catalog of goods, works and services with a description of the characteristics of the goods.
By virtue of subparagraph "b" of paragraph 3 of Part 12 of Article 93 of Federal Law No. 44-FZ of April 5, 2013 "On the Contract System" (hereinafter referred to as Law No. 44-FZ), the customer, when forming a notice of procurement, indicates the name of the goods, as well as its characteristics using the catalog of goods, works, services for state and municipal needs (hereinafter - the catalog).
If the description of the object of purchase containing the characteristics of the goods has not been formed and is not included in the catalog item, there is no possibility of implementing the provisions of subparagraph "b" of paragraph 3 of Part 12 of Article 93 of Law No. 44-FZ, since in this case it is impossible to specify the characteristics of the purchased goods using the catalog in the notification of the purchase.
