Calculation of the initial (maximum) contract price within the framework of quotas under Federal Law No. 44-FZ: recommendations of the Ministry of Finance
When purchasing quoted goods, the peculiarities of determining the initial (maximum) contract price by market analysis apply. They oblige to send price requests to suppliers, information about which is available in the state information system of industry.
According to the Ministry of Finance, such a request may contain all the conditions of the planned purchase. At the same time, the content of the documents as part of the supplier's commercial offer must meet the requirements set by the customer.
In some cases, the initial (maximum) contract price can also be calculated according to the general rules of Federal Law No. 44. This is permissible not only when there is information about less than 3 suppliers in the state information system of the industry, but also if no response has been received from them. In such situations, customers should use price information about goods originating from the member states of the Eurasian Economic Union, the characteristics of which are in the catalog of goods, works, services.
