The procedure for determining the initial maximum contract price for the procurement of shipbuilding industry products has been approved
The Ministry of Industry and Trade of the Russian Federation, in accordance with paragraph 1 of the Decree of the Government of the Russian Federation dated 23.01.2021 N 34, approved the Procedure for determining the initial maximum contract price, the price of the contract concluded with a single counterparty, and the initial unit price of goods when purchasing shipbuilding industry products (with the exception of products purchased under the state defense order) (hereinafter - the Procedure).
The procedure applies to the supply or execution of works on the construction of vessels corresponding to certain codes of the All-Russian classifier of products by types of economic activity, except for cases of determining the initial maximum contract price at the conclusion of a contract, the subject of which is simultaneously the development of a draft and (or) technical design of a vessel and the construction of a vessel. It is necessary to apply the Procedure, in particular, when determining the initial maximum contract price in the case of the purchase of excursion and cruise ships (code of the all-Russian classifier of products by types of economic activity 30.11.21), tankers for the transportation of oil and liquefied gas (code of the all-Russian classifier of products by types of economic activity 30.11.22), bulk carriers (code of the all-Russian classifier of products by types of economic activity 30.11.21), bulk carriers (code of the all-Russian classifier of products by types of economic activity activity 30.11.24), etc.
The document comes into force on April 15, 2023.
Recall that by virtue of Part 22 of Article 22 of Law No. 44, the Government of the Russian Federation has the right to determine:
- the areas of activity in which the procedure for determining the initial maximum contract price, the initial unit price of goods is established during procurement, and
- federal executive authorities, Rosatom State Corporation, Roscosmos State Corporation authorized to establish such an order.
