Advances on contracts with treasury support may be increased
The amount of advance payments in state contracts with treasury support concluded in 2023 can be increased up to 50%, but within the limit of budget commitments brought to the current fiscal year. If the amount of the advance, taking into account these restrictions, exceeds the limits, then the remaining part of the advance payment must be paid no later than February 1 of the next (2024) fiscal year. At the same time, the amount of advance payments may be increased in state contracts concluded before March 6, 2023.
According to state contracts concluded in order to implement decisions on the implementation of capital investments in real estate on the territory of newly annexed subjects of the Russian Federation, advance payments can be increased up to 90%.
The Federal Chief Administrator of budgetary Funds has been granted the right to adopt legal acts providing for the possibility of including conditions on treasury support in the state contract in order to increase the maximum amount of advance payment to 50% for contracts whose price is less than 100 million rubles.
When providing Inter-budget transfers to a subject of the Russian Federation in 2023 for co-financing capital investments in real estate of regional or municipal ownership, the obligation of the subject of the Russian Federation to include in state /municipal contracts conditions on the amount of advance payments from 30 to 50% in the case of treasury support of these advance payments, if higher amounts of advances are not established by the Government of the Russian Federation, should be provided. The exception to this rule is Inter-budget transfers for capital investments in real estate located on the territories of newly annexed subjects of the Russian Federation: advance payments in contracts, the source of payment for which are federal Inter-budget transfers, can be increased up to 90%, subject to their treasury support.
The supreme executive bodies of state power of the subjects of the Russian Federation and local administrations are recommended to take measures to ensure that contracts and contracts for the supply of goods (performance of works, provision of services) concluded by recipients of regional/local budgets, as well as conditions for advance payments in amounts similar to those established for recipients of funds, are included in previously concluded contracts / contracts the federal budget.
