The rules for ensuring the prohibition of purchases under Law N 44 of foreign-made industrial goods have been adjusted
The Government of the Russian Federation has made a number of amendments to Resolution N 616 of 30.04.2020 "On the Establishment of a Ban on the Admission of Industrial Goods Originating from Foreign States for the Purposes of Procurement for State and Municipal Needs, as well as Industrial Goods Originating from Foreign States, Works (Services) Performed (Rendered) by Foreign Persons for the Purposes of procurement for the needs of the country's defense and state security" (hereinafter - Resolution N 616).
In particular, paragraph 2.1, subparagraph "b" of paragraph 6, paragraph 8.1, sub-paragraph "d" of paragraph 15 of Resolution N 616, establishing the specifics of the implementation of the ban established by this resolution in respect of goods produced in the territories of the Donetsk People's Republic, the Luhansk People's Republic, have become invalid. Also, in connection with these changes, the wording of paragraphs 3, p. 10, p. 10.2, p. 10.3 of Resolution N 616, defining the procedure for confirmation by procurement participants of the country of origin of goods, including those originating from the Donetsk People's Republic, the Luhansk People's Republic, has been updated.
In addition, the lists of items of goods have changed in accordance with the annex to the resolution, in respect of which the exceptions provided for in sub-paragraphs "b" and sub-paragraphs "c" of paragraph 3 of Resolution N 616 do not apply. So, in the new edition, the list specified in sub-item "b" of paragraph 3 of Resolution N 616 includes paragraphs of Appendix 28, 50, 142, 145 and a new paragraph of Appendix 147 "Vacuum tubes for taking IVD blood samples". The list of items included in sub-item "b" of paragraph 3 of Resolution N 616 is supplemented by paragraphs of Appendix 20 and 21.
Also, the lists of goods specified in the annex to Resolution N 616 have been adjusted, the purchases of which by "power" ministries and departments are not subject to the exception provided for in sub-paragraph "d" of paragraph 3 of Resolution N 616.
The annex to Resolution N 616 has been supplemented with new positions.
These amendments entered into force on March 1 of the current year and do not apply to relations related to procurement, notices of which are posted in the Unified Information System, invitations to participate in which are sent before the specified date, including contracts, information about which is included in the register of contracts before the specified date.
