The list of banks authorized to maintain special accounts has been supplemented
MTS-Bank Public Joint Stock Company is included in the list of banks approved by the Decree of the Government of the Russian Federation dated 13.07.2018 No. 1451-r, to whose accounts funds are deposited intended to secure applications for participation in electronic procurement procedures provided for by Law No. 44 (hereinafter referred to as the List).
The new version of the List is valid from February 20 of this year.
Recall that according to Part 4 of Article 44 of Law No. 44, the security of an application for participation in a competitive procurement can be provided at the participant's choice in the form of:
- cash;
- an independent guarantee provided for in Article 45 of Law No. 44.
As follows from sub-item "a" of paragraph 1 of Part 5 of Article 44 of Law No. 44-FZ, if the participant of the electronic procedure has decided to provide security for the application in the form of funds, the specified funds in sufficient amount to secure the application must be deposited by the participant to the bank account opened by the participant in the bank included in the The list.
The requirements for banks in which participants open special accounts for depositing funds supporting applications are set out in paragraph 1 of the Decree of the Government of the Russian Federation dated 20.12.2021 N 2369.
The requirements to the special account agreement, to the procedure for using the bank account available to the participant as a special account are established by the Decree of the Government of the Russian Federation No. 626 dated 30.05.2018.
