The rules for concluding agreements on the transfer of the right to use RID for state and municipal needs, as well as standard forms of contracts, are established
In accordance with sub. 4 p. 12, article 1240.1 of the Civil code, which came into effect on January 1, 2022, the Russian Government approved the Rules for concluding the model license agreements grant the right to use REED for state or municipal needs, as well as typical forms of the respective license agreements (Decree of the Government of the Russian Federation of November 30, 2021, No. 2143).
Recall that by virtue of paragraph 7 and paragraph 8 of article 1240.1 of the civil code of the relevant contracts are concluded in cases where the exclusive right to REID, created by a state or municipal contract:
does not belong to the state, the subject of the Russian Federation or the municipality;
it belongs jointly to the performer and the state, a subject of the Russian Federation or a municipal entity.
