The procedure for the preparation of legal acts on the determination of the sole counterparty in procurement under Law No. 44-FZ has been adjusted
Paragraph 9 of the Procedure for preparing draft legal acts and instructions of the President of the Russian Federation, draft legal acts of the Government of the Russian Federation on determining the sole supplier (contractor, performer) of goods, works, services in the Course of their procurement for state Needs, approved by Presidential Decree No. 558 of September 14, 2020, has been supplemented with a new subparagraph "d". According to the specified subparagraph, the relevant expert opinion will be formed, including taking into account the conclusion of the Ministry of Industry and Trade of the Russian Federation on the presence (absence) in the registers of industrial products or in the unified register of Russian radio-electronic products of information about goods that are the subject of a state contract and (or) information about which is contained in the proposal to determine the counterparty (Decree of the President of the Russian Federation dated November 11, 2021 No. 641).
These changes will take effect on January 1, 2022.
