They proposed the conditions and methodology for changing state contracts for the repair of roads with an increase in the cost of materials
The Ministry of Transport wants to support the road construction industry due to the increase in the cost of price-forming resources. Thus, federal customers from the special district will be able to adjust contracts for the repair of public roads of federal significance and their technological parts on the basis of Article 111 of Law No. 44-FZ. You can make changes if several conditions are met: the
contract is concluded until July 1, 2021;
the obligations under the contract as of the date of conclusion of the agreement on changing its terms are not fulfilled;
there is a documented proposal of the contractor for an adjustment;
the adjustment is within the LBO and does not increase the contract execution period or its price by more than 30%;
the amount of the price increase is determined according to the method from Appendix No. 2 to the draft resolution. An example of an adjustment is given in the appendix to the methodology.
The draft resolution recommends that regional and municipal state customers, customers under Law No. 223-FZ, also take into account innovations.
The public discussion of the project ends on September 29.
