The procedure for issuing a request for the termination of actions containing signs of violation of the legislation on the state defense order is defined
The FAS of Russia, in accordance with clause 1.1 of Part 1 of Article 15.2, Article 15.9-1 of Federal Law No. 275-FZ of December 29, 2012 "On the State Defense Order", approved the Procedure for issuing a request to terminate actions (inaction) that contain signs of violation of legislation in the field of the state defense order (hereinafter referred to as the Procedure), as well as the form of this requirement (Order of the FAS of Russia No. 510/21 of May 26, 2021 (zareg. in the Ministry of Justice on August 20, 2021). According to the Procedure, the corresponding requirement is issued to economic entities occupying in accordance with art. 14 of Law No. 275-FZ, the dominant position, in case of detection of signs of unjustified evasion of a potential contractor from entering into a contract. The deadline set in the request for its implementation should not be less than 10 working days from the date of its receipt by the economic entity, but within the limitation period for bringing to administrative responsibility under Article 7.29.2 of the Administrative Code, taking into account the duration of the procedural actions necessary to initiate and consider an administrative offense case. In this case, the specified period may also be extended within the limitation period.
