The Law N 223-FZ wants to introduce, and in public procurement to clarify the provisions on the conflict of interests

According to the Law N 223-FZ, the head of the customer, a member of the procurement commission will take measures to ensure that there is no conflict of interest in the purchase (p.1 of the project). The amendments were submitted to the State Duma.
Members of the commission will not become (p. 2 of the project):
* an individual with a personal interest in the purchase;
* participants (shareholders) of organizations that submitted applications, members of their management bodies, creditors;
* other individuals from the procurement regulations.
Law No. 44-FZ already contains a list of possible participants in a conflict of interest. It is necessary to refine this list. In particular, they specify which management bodies of the legal entity participating in the purchase will enter into a conflict of interests with the customer (p.4 of the project). For example, the founder of a unitary organization.
In particular, the head and employees of the contract service, members of the procurement commission, and the contract manager will ensure that there is no risk of a conflict of interest (p.5 of the project).
