Requirements are established for participants in purchases under Law No. 223-FZ, organized for the completion of the construction of objects of bankrupt developers
The Ministry of construction of Russia in accordance with paragraph 5 of article 21.1, part 1 of article 23 of the Federal law of 30 December 2004 No. 214-FZ "On participation in shared construction of apartment houses and other real estate and on amendments to certain legislative acts of the Russian Federation" adopted the following requirements to procurement participants associated with the delivery of goods, performance of works or provision of services necessary for the completion of the object under construction or infrastructure project, the rights to which are transferred in the manner prescribed by article. 201.15-1 - 201.15-2-1 Federal Law No. 127-FZ of October 26, 2002 " On Insolvency (Bankruptcy)":
lack of information about the procurement participant in the RNP under Laws No. 223-FZ and No. 44-FZ;
the presence of experience in the execution of the contract for the last 5 years before the date of submission of the application, the cost of which meets the established requirements.
These mandatory qualification requirements apply to participants in competitive procurement (Order of the Ministry of Construction of the Russian Federation No. 810/pr of December 21, 2020). The corresponding order comes into force on March 29, 2021 and applies to purchases, notifications about the implementation of which are posted in the EIS or invitations to participate in which are sent after the specified date.
