Updated the list of customers who do not prohibit the purchase of foreign goods in accordance with Resolution No. 616

The Russian government has made changes in podp. "d" and "e" paragraph 3 of the decision of 30 April 2020, No. 616 "About establishment of a ban on the admission of industrial goods originating from foreign States for the purposes of procurement for state and municipal needs, and industrial goods originating from foreign States, works (services) performed (rendered) by foreign persons for the purposes of procurement for the needs of national defense and state security" (hereinafter – Decree No. 616) (Decree of the RF Government dated December 31, 2020 No. 2407).

In particular, in accordance with the amendments expand the circle of organizations that the procurement is allowed to set prohibition of the admission of foreign manufactured goods, and adjusted the list of goods, the prohibition of purchases for which this case applies. Thus, the mentioned entities include organizations that are subordinate to the organizations specified in sub-item "d" of paragraph 3 of Resolution No. 616. At the same time, the reference to subsections 123, 126 of the list of industrial goods is excluded from this subparagraph for the purpose of applying the corresponding exception. 

In addition, according to the new version of sub-item " e " of paragraph 3 of Resolution No. 616, the ban on the admission of foreign products does not apply, among other things, to the purchase of vehicles by the Ministry of Internal Affairs of Russia for carrying out operational search activities.
Changes in the Resolution No. 616 entered into force on 6 January 2021 and do not apply to relations associated with the procurement, notice on the implementation of which is housed in EIS until the day of entry into force of the relevant decree of the RF Government, including to contracts, information about which is included in the register of contracts signed by customers before the specified date.
