The procedure for consideration by the Government of the Russian Federation of requests to determine the sole counterparty in the course of procurement under Law No. 44-FZ is defined
The government of the Russian Federation approved the regulation on the procedure of consideration by the Government of the Russian Federation cases about the definition of a sole supplier (contractor, executor) of goods, works, services when implementing their procurement for state needs (hereinafter – the Regulation) (regulation of the government of the Russian Federation from October 10, 2020 No. 1649).
The document defines, in particular, the modalities of treatment and be included in the composition information, the rules of consideration of appeals.
There is also a procedure for preparing an expert opinion of the government of the Russian Federation issued for the corresponding appeal. The form of expert opinion was approved.
This provision does not apply to the following cases:
- determination of the sole executor when forming and approving the state defense order by the Government of the Russian Federation;
- preparation of draft legal acts of the Government of the Russian Federation aimed at fulfilling the instructions of the President of the Russian Federation given before approval of the Procedure for preparing draft legal acts and instructions of the President of the Russian Federation, draft legal acts of the Government of the Russian Federation on determining the sole supplier (contractor, performer) of goods, works, and services when purchasing them for state needs.
The document comes into force on October 22 this year.
