In energy service contracts should take into account the rules naziregime for electronics
FAS indicated that when conducting a procurement for the implementation of measures under energy service contract actually supplied the lighting equipment that is transferred to the property of the customer.
If the named contract includes radio-electronic products from the list approved by resolution N 878, then customers must set in the procurement documents the restrictions on admission under this resolution or place in the EIS a justification that they cannot be met.
It is also necessary to reflect the conditions of admission in the purchase, if the purchased product is in the list, which is fixed by the Order of the Ministry of Finance of 04.06.2018 N 126n.
Previously, the FAS explained that if a participant declared the country of origin of a radio-electronic product, but did not specify the number of the registration record, then its application is considered as an offer of a foreign product.
In a new letter, the Antimonopoly authority noted that in such a situation, the conditions of admission from the mentioned order apply.
