The Ministry of Health approved the procedure for determining the NMCC in state purchases of medical products
The department determined how the state customer will calculate the NMCC, the price of a contract with a single supplier, the initial price of a unit of goods (work, services) when purchasing medical products. There are some exceptions. The new rules will take effect on August 31st.
For which purchases the order will not apply
The approved procedure is not applied to substantiate the NMCC in the procurement of medical devices:
disposable made of polyvinyl chloride plastics - if these are goods from foreign countries included in the list approved by Decree of the Government of the Russian Federation of 05.02.2015 N 102;
supplied under the state defense order;
included in the register of the Russian REP - if the customer has established restrictions on the admission of foreign products.
The new rules will also not apply to the rationale for the NMCK (the price of a contract with a single supplier, the initial unit price) for purchases that were posted before August 31, 2020.
What methods of calculating prices will be used
Prices will be determined as follows:
as a weighted average of prices collected by the customer excluding VAT;
by the method of comparable market prices - in the cases provided for in clauses 3 and 4 of the Procedure;
using the tariff method - when purchasing products for which state price regulation is established.
The customer will be able to reduce the obtained value of the NMCK based on the available volume of financial security.
How to determine the weighted average of prices
The customer will use the weighted average to determine the initial unit price of the medical device, as well as the unit price of the medical device, consumable, medical device maintenance service that does not use the tariff method or exclusively the comparable market price method. This value is calculated using:
method of comparable market prices;
information from the register of contracts confirming the performance of participants within 3 years prior to the date of filing an application for participation in the procurement of three contracts executed without penalties. Consideration will be given to contracts concluded as a result of competitive purchases and purchases from a single supplier under clause 1, part 1 of Art. 93 of Law N 44-FZ with an identical procurement object and comparable commercial and financial terms. Priority will be given to contracts executed in the territory of the constituent entity of the Russian Federation of the customer or adjacent to him. Succession is not considered.
When the method of comparable market prices (market analysis) is used
The method of comparable market prices (market analysis) is applied:
when purchasing technical means of rehabilitation, which are included in the list approved by the Order of the Government of the Russian Federation of December 30, 2005 N 2347-r;
when calculating the price per unit of a medical device, consumable material, medical device maintenance services for the warranty period;
when purchasing from a single supplier under clauses 3, 6, 9, 11, 12, 35, 40, 41, 46 h. 1 of Art. 93 of Law N 44-FZ.
Features of calculating the initial price per unit for the purchase of consumables and maintenance services
The customer will determine the need for consumables and maintenance services for the warranty period, taking into account the planned intensity of the operation of the medical device.
Consumables include products and components that:
used in the operation of medical devices;
ensure the use of a medical device for medical purposes in accordance with its functional purpose;
are contained in the manufacturer's (manufacturer's) operating documentation for the medical device.
To form the cost of consumables and the cost of maintenance, you will need a warranty period (at least 12 months). The customer will install it in accordance with the operational documentation for the medical device. If the necessary information is not available, the period will be 24 months from the date of transfer of the medical device to the customer.
Entry into force
The approved order will start working on August 31, 2020.
